Terms governing access to and use of Victus Cloud services.

Agreement and related policies

These Terms form an agreement between you and Victus Cloud. By creating an account, placing an order, or using a service, you agree to them. If you do not agree, do not use the services.

The Privacy Policy, Acceptable Use Policy, and Refund Policy also apply. Product-specific terms shown in an order control for that product if they conflict with these general Terms.

Accounts and eligibility

  • You must be legally able to enter into this agreement. If you use the services for an organization, you represent that you can bind it to these Terms.
  • You must provide accurate information, keep it current, protect account credentials, and promptly notify support of suspected unauthorized use.
  • You are responsible for activity under your account and for users to whom you provide access.

Orders, billing, and renewals

Prices, billing periods, resources, and any renewal terms are shown at checkout or in the applicable order. You authorize the selected payment provider to process charges and must keep billing information accurate. Taxes or payment-provider fees may apply where shown or required.

Failure or reversal of payment may result in restriction, suspension, or termination of the affected service. Refund requests are governed by the Refund Policy.

Use of services and customer content

You may use the services only for lawful purposes and in accordance with these Terms and the Acceptable Use Policy. You are responsible for your content, configurations, software, users, backups, and compliance with third-party rights and applicable law.

You retain rights you hold in content you submit. You grant Victus Cloud a limited permission to host, copy, transmit, and otherwise process that content only as needed to provide, secure, support, and comply with law for the services.

Third-party software, integrations, or services may have separate terms. Victus Cloud is not responsible for third-party products you choose to use.

Availability, changes, and backups

Services are provided on an “as available” basis. Maintenance, faults, security events, third-party failures, or events outside reasonable control may interrupt access. No uptime, response-time, or recovery commitment applies unless it is expressly included in your specific order or written agreement.

Features, resource limits, or services may change. You are responsible for maintaining appropriate independent backups and testing restoration unless a specific written agreement says otherwise.

Suspension and termination

We may restrict or suspend a service when reasonably necessary to address security threats, unlawful activity, non-payment, material or repeated policy violations, harm to the services or others, or a valid legal request. Where practical and appropriate, we may provide notice or an opportunity to resolve the issue, but urgent action may be taken without advance notice.

You may stop using the services and cancel through available account or support channels, subject to the applicable billing terms. Following termination, access to services and content may end. You should export content before cancellation. Provisions that by their nature should survive termination remain in effect.

Disclaimers and responsibility

To the extent permitted by law, the services are provided without implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded.

To the extent permitted by law, Victus Cloud is not responsible for indirect, incidental, special, consequential, or punitive losses, or for loss of profits, revenue, goodwill, or data arising from use of the services. Any liability will be assessed under applicable law and the terms of the relevant order; these Terms do not create an unverified fixed remedy or service-level promise.

Changes and general terms

We may update these Terms when services or legal requirements change. The revised Terms will be posted here with a new updated date. Additional notice will be provided where required. Continued use after revised Terms take effect constitutes acceptance where permitted by law.

If a provision is unenforceable, the remainder continues in effect. A failure to enforce a provision is not a waiver. You may not transfer your agreement without our consent; Victus Cloud may transfer it as part of a reorganization or transfer of the relevant service, subject to applicable law.
