Notice, takedown, counter-notice, and repeat infringer procedures governing copyright compliance across all Victus Cloud hosting services and platforms.

DMCA Compliance Overview

Victus Cloud respects the intellectual property rights of artists, developers, authors, and organizations. We respond expeditiously to legitimate notices of alleged copyright infringement in accordance with the safe harbor provisions of the United States Digital Millennium Copyright Act (17 U.S.C. § 512), the European Union Directive on Copyright in the Digital Single Market, and applicable local intellectual property frameworks.

This policy applies across all Victus Cloud infrastructure, including Minecraft and game server hosting, managed web hosting, virtual private servers (VPS), Discord bots, Victus Workspace, cloud file storage (/files), and image sharing (/images).

1. Designated Copyright Agent Contact Information

Victus Cloud respects the intellectual property rights of creators and content owners. In accordance with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, and international intellectual property laws, our Designated Copyright Agent for receipt of notifications of claimed infringement and counter-notifications is:

Note: Inquiries sent to this email address that are not related to copyright infringement (such as technical support, password resets, or billing issues) will not receive a response from the DMCA agent.

2. Filing a DMCA Notice of Infringement

If you believe in good faith that your copyrighted work is being copied, distributed, or hosted through any Victus Cloud service (including game server instances, VPS nodes, web hosting, image hosting at /images, file hosting at /files, or Discord bots) in a manner that constitutes copyright infringement, you must provide a written notice containing all of the following statutory elements (17 U.S.C. § 512(c)(3)):

  1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of Infringing Material & Precise Location: Identification of the material that is claimed to be infringing or to be the subject of infringing activity, along with information reasonably sufficient to permit Victus Cloud to locate the material (e.g., exact URLs, server IP/port combinations, unique file IDs, or workspace resource paths).
  4. Claimant Contact Information: Information reasonably sufficient to permit us to contact you, such as your full legal name, physical mailing address, telephone number, and email address.
  5. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law (such as fair use).
  6. Accuracy & Perjury Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Takedown & Forwarding Protocol

Upon receipt of a formal notification containing all required statutory information:

  • Victus Cloud will act expeditiously to remove, disable access to, or quarantine the allegedly infringing material.
  • We will immediately forward a complete copy of your written notice (including your contact information and allegations) to the subscriber or account owner responsible for the affected resource.
  • We will inform the subscriber of their legal right to submit a DMCA Counter-Notification pursuant to 17 U.S.C. § 512(g).
  • Server logs, file metadata, and communication records will be preserved in accordance with our legal obligations.

4. Submitting a DMCA Counter-Notification

If material hosted on your account has been removed or disabled as a result of a DMCA takedown notice, and you believe this was due to a mistake, misidentification, fair use, or that you have proper authorization to use the content, you may send a written Counter-Notification to dmca@victuscloud.com.

To be effective under 17 U.S.C. § 512(g)(3), your Counter-Notification must include:

  1. Your Physical or Electronic Signature: Your full legal signature (typed or scanned).
  2. Identification of Disabled Material: Identification of the material that was removed or disabled and the location (URL, file ID, or server IP) at which the material appeared before it was removed.
  3. Statement Under Penalty of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Subscriber Contact Information: Your full legal name, physical address, and telephone number.
  5. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the competent courts in your judicial district (or Dubai, UAE for international accounts), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.

5. Content Restoration Timeline

Upon receiving a valid and complete DMCA Counter-Notification:

  • We will promptly forward a copy of the Counter-Notification to the original complaining party, informing them that Victus Cloud will restore access to the material or cease disabling access within 10 to 14 business days.
  • Unless our Designated Agent receives official written notice from the complaining party that they have filed a court action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material, Victus Cloud will restore or enable access to the removed material between 10 and 14 business days following receipt of the counter-notice.

6. Repeat Infringer Policy (Termination)

In accordance with Section 512(i)(1)(A) of the DMCA and our Terms of Service, Victus Cloud maintains and strictly enforces a policy for the termination, in appropriate circumstances, of accounts and service instances of subscribers who are deemed repeat infringers.

  • Victus Cloud logs and tracks all confirmed DMCA takedown notices linked to customer accounts.
  • Subscribers who receive multiple substantiated infringement notices without valid counter-notices will face immediate and permanent account termination, cancellation of active hosting plans, forfeiture of stored files, and permanent blacklisting.
  • Accounts terminated under the Repeat Infringer Policy are strictly ineligible for refunds under our Refund Policy.

7. Warning Against False Claims & Perjury

Under Section 512(f) of the DMCA and applicable international civil law, any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed by mistake or misidentification, may be subject to severe legal liability.

This liability includes payment of all damages, court costs, and reasonable attorneys' fees incurred by the alleged infringer, by any copyright owner or authorized licensee, or by Victus Cloud as a result of relying upon such misrepresentation in removing or disabling access to material.

8. Trademark, Trademark Abuse & Non-Copyright Inquiries

The DMCA statutory process applies specifically to copyrighted works.

For reports involving phishing, malware, distributed denial-of-service (DDoS) botnets, network abuse, spam, child exploitation, harassment, or trademark infringement, do not use the DMCA process. Please submit your claim directly through our dedicated Abuse Reporting Center or email support@victuscloud.com.
